The hardship affidavit form is filed during certain adverse circumstances when the homeowner is unable to pay the stated mortgage loan payment that had been previously decided. The form is a request to decrease the payment to a certain extent so that the homeowner is able to prolong his ownership. The reasons for this request should be explicitly stated in the form. It must be ensured that all provisions within the affidavit form are in accordance to the Home Affordable Modifications Program under the federal government’s terms and conditions. The deputy clerk or notary public is required to be present for such forms.
