Deed of Trust Form



When a borrower loan some money from a lender, one way of securing the payment is getting a trustee to hold the land title of the borrower to supplement the debt of the borrower, this kind of payment is called the deed of trust or trust deed. When applying for this kind of arrangement when borrwowing a money from a loan company or lender, a deed of trust form must be filled up.

This form elaborates the terms and conditions of the loan agreement, like the borrower or debtor gives the title of his or her land to the trustee or temporary owner of the land, when the debtor paid all the debts then the ownership of the land will be given to hom or her.

In case that the borrower did not pay the exact amount or just the partial debt, the trustee then has the right to sell the property to pay the full debt and give back the excess to the borrower. Like any loan agreement form, it must be filled up by the borrower himself/herself and must agree to the conditions listed in the form, it is then notarized to make it legal and valid to assure that any breech to the contarct has a corresponding payment or penalty.
